De wettekst van een constitutie (grondwet of staatsregeling) interesseert de doorsnee burger doorgaans niet. Eigenlijk is dat zeer vreemd, want de burger heeft dagelijks met de regels en effecten van de constitutie te maken. Eigenlijk zou ieder burger een kopie van de constitutie in huis moeten hebben en moeten weten wat erin staat. Elke mddelbare scholier zou onderricht moeten krijgen over de inhoud van de constitutie.

Na de ondergang van de West-Indische Compagnie heeft Nederland het Cari-bische gebied verwaarloosd. O zeker, er waren nog steeds wat overzeese gebiedsdelen daar, waarvan iedere Nederlandse lagere-school leerling de namen uit het hoofd moest leren, maar meer dan die gortdroge opsomming van de ABC eilanden hoefde geen leerling te weten. From the beginning Bonaire has insisted that the Dutch police force should take over responsibility in BES, once the new constitutional arrangement takes effect. This has found its way into articles 11 and 12 of the Final Declaration. It was agreed that Holland will assume responsibility for law enforcement in BES (art. 11). And to fulfill this responsibility Holland will organize law enforcement in cooperation with the police forces of the other islands (probably mainly Curaçao).

De vraag is aan ARCO gesteld of een eigen fiscaal- & premiestelsel goed is voor BES? Wij menen van wel, onder voorwaarde dat het ‘compensatie-beginsel’ van art. 299 EU-verdrag door Nederland wordt erkend. Dit betekent dat de tarieven in BES lager mogen zijn dan in Nederland, terwijl toch de koopkracht van de burger gelijk blijft aan de koopkrcht in Nederland (of daar zo dicht mogelijk bij komt). Dit laatste op grond van het gelijkheidsbeginsel.

Sabaanse kapiteins zijn beroemd. Bonaireaanse botenbouwers van Nederlandse origine waren vroeger in het Carbisch gebied alom bekend.

As we see in the article on ‘subsidiarity’, it has been agreed that decisions in BES will be made as close to the BES-citizen as possible. In other words, as much as possible will be decided on the islands.

Subsidiarity
Art. 7 of the Final Declaration (‘Slot-verklaring’) says that the islands will carry out as many tasks as possible themselves.  This is the mainly European ‘principle of subsidiarity’ (although it is also expressed in the US Constitution). In the Antilles we usually call it ‘autonomy’, although some would argue there is a difference between the two. It is very important for us (BES) to understand what ‘subsidiarity’ means.

Apart from Island Council elections, BES-citizens will in future participate in Dutch parliamentary elections for the so-called ‘Second Chamber’ (= ‘Tweede Kamer’). The Island Councils of Bonaire, Saba and Statia will then participate in the election of First Chamber members (= approx. the Dutch ‘Senate’). This was agreed in art. 6 of the ‘Final Declaration’ (= Slotverklaring’).

It was somewhat amusing to see public officials from Holland coming over to assess the ‘political risks’ involved in this new relationship with BES. Apparently these 3 tiny islands pose a risk? Maybe the God BES (see page 14) is mightier than we thought!

This still is the six-million dollar question. Or 6 million Euro’s? No decision has yet been reached. The majority of financial experts have recommended we choose the US$. As we understand it, you don’t have to ask permission for that. The US is delighted if we go for their greenback.

During the past 50 years Antillean policy has been to keep Dutch nationals from Holland (‘European Dutch’ nationals) out, treating them like foreigners basically.
This was all done quite legally, even with Holland’s consent. European Dutch people like to dispute this, but art. 3, section 1, sub f of the Kingdom Sta-tute clearly states that ‘supervision’ on [the making of] ‘general rules regarding admission and expulsion of Dutch nationals’ is a so-called ‘Kingdom affair’ (‘Koninkrijksaangelegenheid’), meaning that Holland has a decisive say when any of these rules or laws are enacted.

IJkpunt
Op 20 juni 2007 is afgesproken dat het BES-voorzieningenniveau in de nieuwe situatie (na 15 december 2008) niet langer geijkt zal zijn aan het niveau van Curaçao. Helaas is toen niet afgesproken aan welk niveau het dan wel geijkt zal worden. Wij hopen dat deze editie mag bijdragen tot het inzicht dat voor BES in de nieuwe si-tuatie het Nederlandse niveau ijkpunt zal moeten zijn.

De term ‘bijstandnorm’ is volkomen onjuist. Hij is gebaseerd op het begrip ‘bij-stand’ (= inkomen zonder werken), een zeer ongezonde basis voor een samenleving. Maar die ongezonde basis heeft Nederland zichzelf al gegeven en zal Nederland zelf moeten rechtzetten. Feit is dat de term ‘bijstandnorm’ in het Nederlands taalgebruik de betekenis heeft gekregen van ‘minimum-levensstandaard’. Wij zullen het in die betekenis gebruiken.

Nuevas preguntas sobre el proceso de descolonización en el Caribe a partir del proceso de globalización.

El título tan extraño de mi conferencia en si mismo provoca preguntas. Espero que al final se entiende mejor el significado de ese nuevo dicho. El resultado del proceso de descolonización fue el mismo, la independencia, aunque las formas fueron diferentes. Para muchos países fue fruto de una intensa lucha armada de liberación nacional, para otros fue producto de largas negociaciones sin violencia y para algunos fue simplemente impuesto por el país colonizador. El proceso de globalización sin embargo plantea nuevas preguntas a una vieja pregunta: ¿que significó realmente la independencia? Mi análisis está situado en un determinado contexto, estoy pensando en voz alta desde una pequeña isla, un mini-estado insular, Aruba que pertenece al Caribe holandés.
